This website is operated by Lewins Jewellers. Throughout the site, the terms “we”, “us” and “our” refer to Lewins Jewellers. Lewins Jewellers offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. PRODUCT DESCRIPTIONS & DETAILS
Products supplied with metal and diamond weights, are gauged and are approximate estimates only. Unless stated otherwise, these are guides. Only when clearly stated, under the description and details section of each product, jewellery may be supplied with certificates/reports. Not all products on our website, will be supplied with certificates/reports. We will only use universally recognised and accepted gemmological laboratories, to provide such documents. When stones are set into jewellery, it is not possible to ascertain their individual quality grades, nor their exact weights, because of limitations imposed by the mountings. In the absence of certificates/reports, we can only place estimated quality assessments on these gemstones and then calculate value conclusions, based upon these assessments and the estimated weights. We do not warrant that product descriptions or other content of this site is without error, but we endeavour to ensure all information is correct and up to date. It is possible that some inaccuracy in the description, may occasionally occur which is wholly unintentional and we cannot be held responsible if any description is incorrect. If you have any queries regarding any product or content of the site, please contact us. If a product offered by us is not described to a satisfactory level, your sole remedy is to return it, in unused condition and we will arrange a refund or replacement.
SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
PRICE FLUCTUATIONS
Our prices and values, represent current retail trends and are based on market forces. Precious metals, precious and semi-precious gemstones, like any other commodity are controlled by supply and demand, and are also affected by exchange rates. Precious metals, precious and semi-precious gemstones are traded universally in US dollars. Political situations and market forces cause world-wide fluctuations in exchange rates. With such variables it is, therefore inevitable, that jewellery prices will fluctuate through different periods of time. Prices stated on our website, are in UK Pounds Sterling and are based on fluctuating metal and gemstone prices. We endeavour to keep prices at constant levels, but we reserve the right to change prices at any time when the need arises. Once an item has been purchased and we have received payment for it, we will always honour the price quoted. In the event of a pricing error, we will endeavour to honour the cheapest price but do reserve the right to cancel any order without liability, which would be uneconomic or where the price has been abused. If our prices decrease after you have placed your order or after you have received your goods, you are not entitled to receive the difference back, as goods have already been purchased from our manufacturers at the higher price.
SECTION 5 - PRODUCTS OR SERVICES (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
IMAGES & VIDEOS
Photographs and videos are for illustration only. Our product images and videos have been provided, to give an example of the final product. Actual products may vary slightly. Images do not represent an item’s true size and as such, dimensions are supplied when the data is available. We are therefore unable to guarantee that the product images you see, are an accurate representation of the actual merchandise. As diamond, gemstone and metal are natural materials, they can vary in colour, shade and appearance from the product image. Photography lighting can also affect the colour or shade, so images will show jewellery brighter than in normal light. The perception of colour is affected by the presence and quality of light. Different digital devices feature different monitors and screen technology, to display colour. A bright back-lit desktop screen compared to a small LCD screen on a mobile phone, will show the same picture in a different colour. It should therefore be understood, that for instance - the actual colour of gemstones/metals in the jewellery you receive, might look slightly different in colour, than that of the picture you have seen online.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
FULFILLING ONLINE ORDERS
In the event that an item is sold in our showroom, at the same time as it (being the same item) is sold online, we reserve the right to cancel the internet sale without liability. Once you have completed the checkout process, we will send you an order confirmation email, detailing the products you have ordered. This is not an order acceptance. Order acceptance and completion of the contract between you and us, will take place on the day of despatch, unless we have notified you that we do not accept your order. We reserve the right not to accept an order, for any reason, this may be the result of, but not limited to one of the following: The product you ordered being unavailable from stock. Our inability to obtain authorisation for your payment. The identification of a pricing or product description error. If you have not met or complied with the term and conditions of sale. Your order not passing our verification checks. We have reason to suspect fraud.
DELIVERY
For security reasons, our policy is to only deliver to the registered billing address of the customers payment card. Free deliveries are only available to orders over £100.00, all deliveries will be dispatched via Royal Mail Special Guaranteed Delivery Service and are fully trackable. All delivery dates quoted by us at the time of your order and after, are approximate. We will make every effort to ensure that we are able to honour estimated delivery dates. However, it is possible that circumstances beyond our control, that are affecting Royal Mail’s delivery services, may cause delivery dates to be changed/rescheduled. We will not be held responsible for services supplied by third parties or delays within the postal network. We will endeavour to deliver orders within the agreed period, but we cannot be held liable for any loss caused by late delivery. If we do deliver late, you are not entitled to regard this as a breach of contract.
OWNERSHIP, RISK & TITLE
All items purchased from our website, are made pursuant to a shipment contract. This means all items are fully insured and sent at the risk of Lewin Jewellers. However the risk of loss and title of ownership for such items, shall pass to you, the buyer, upon delivery and acceptance of the order. We use a trackable delivery service and a signature will be required on delivery. We won't deliver to your next door neighbour if you're out and we won't leave it near your door or property either. To keep your order safe we'll deliver to your delivery address only and a signature will be required. If you are not at home during your delivery time, Royal Mail will leave you a contact card, so you can re-arrange delivery for a suitable time or date.
MISSING ORDERS
In the unlikely event that your order goes missing once it has left Lewins Jewellers, the following procedures apply. Due to postal carrier regulations, orders are not declared as ‘lost in post’ until a specific number of days elapses, because there is a chance that your order may still be delivered late. Before a claim can be raised for an order 'lost in post', 10 workings days from the last status update must have passed. Once the numbers of days have elapsed, we will re-issue your order or cancel your order and refund any monies paid depending on the individual circumstances. If your order has been signed for, but you have not received it, you can check the signature using the tracking link sent to you. If you are still unable to locate the parcel, then please let us know immediately, so we can make a compliant to the carrier. The time taken for to resolve a complaint with carriers can vary depending on the actions required. In the first instance, the carrier will make an enquiry with the Delivery Officer, which in most cases are concluded within 48 hours. If the enquiry cannot be resolved within 48 hours, we will need to submit a claim form to the carrier. This is more common in instances where receipt is denied (i.e. there is a signature for the parcel but you do not recognise this). In this case, the carrier will undertake a mail fraud investigation and you may be contacted by the Police. Please be aware that such claims can take up to 30 days to be resolved. Once the claim has been resolved, we can then re-issue your order or cancel your order and refund any monies paid depending on the individual circumstances.
CANCELLATIONS OF ONLINE ORDERS
If you have ordered an item without bespoke service, you can cancel the order at any time prior to dispatch, by contacting us. If you have ordered an item with bespoke service, there is a 24 hour grace period after processing your order, whereby you have the right to cancel. After the grace period, work will have commenced upon your bespoke service request and the order cannot be cancelled, returned or refunded.
RETURNS OF ONLINE ORDERS
Under the Consumer Contracts Regulations, you have the right to cancel your order with us, at any time within 14 days of receiving your goods. Should you cancel the contract we will then refund you the price you have paid for the goods, this will not include delivery charge, if you have cancelled after your order has been dispatched. You are under a duty to take reasonable care of the goods, which means the goods must be unused and unworn. Please see our returns policy, for more information on: (1) requesting for a return, (2) the full list of exclusions that apply to jewellery which cannot be returned nor refunded, (3) what you must include in your return and (4) the Lewins Security Tag and Labels. Items must be returned in the same condition as they were received by you – damaged, broken or altered items, will not be accepted for a refund. It is the customers responsibility, to return the goods to us via insured and tracked delivery and cover postage costs. It is the customers responsibility, to make themselves aware of the returns policy including the list of exclusions that cannot be returned, before processing any order.
GUARANTEE
All our jewellery is guaranteed against manufacturing defects for 12 months from date of delivery. Manufacturing defects may include; casting or setting errors. This guarantee does not cover damage caused during wear, this may include: scratches, dents, cracks in metals (unless caused by a manufacturing error), damaged settings, broken/cracked/chipped or missing diamonds or gemstones. It does not include the wear, of rhodium plating on any silver or white gold jewellery, as the rate of wear depends on the conditions it is consistently exposed to. Upon claiming under this guarantee, we must inspect the item to establish how the issue has occurred. We may ask you to provide us with photographs, before returning the item. After we have received the item, it will take 5 day for the claim to be reviewed. After which a written assessment will be submitted to confirm that the jewellery has experienced a manufacturing defect or customer damage. Should the item be damaged and show no sign of a manufacturing defect, then we may offer a price quote for repair, if possible at our discretion. Our manufacturer backed quality guarantee is not to be confused with a warranty or insurance, we send information on third party insurance providers with all orders and recommend customers take out their own insurance policies. It is the customer responsibility to return the goods to us via insured and tracked delivery and cover postage costs, if the issue is found to be a manufacturing defect then you may make a claim for postage to be refunded. We will cover the costs of returning your jewellery back to you. We do not provide guarantees on watches, we only supply watches from third party brands and manufacturers who may have their own manufacturers guarantee still included depending on the age of the watch.
IN-STORE DEPOSITS & LAYAWAYS
All goods placed on deposit must be paid within the time frame agreed or within 3 months. After this period the deposit will be forfeited and the goods will be returned to stock. All deposits are non-refundable.
IN-STORE REPAIRS & SERVICES
You will be given a repair ticket, for any item left or entrusted to us, for a repair or service describing its general external condition, as observed at the time you submit the item. We will inform you once the repair or service has been completed. The repair ticket must be presented when the repair is collected. If you loose your ticket, full photographic identification must be presented, in order to collect your item. If it is possible to determine the price of the repair when the item is submitted, you shall approve the repair by proceeding with submitting the item. By submitting the item the Customer shall be deemed, to have accepted the price. If it is not possible to determine the price of the repair when the item is submitted, we will send the item to our workshop for an “estimate”. The “estimate” shall indicate the scope of the repair or service, its price and the estimated time required to carry out the work. Once you have accepted the Estimate, and have initiated the repair or service, you cannot withdraw its consent. If, despite commercially reasonable efforts, we cannot complete the repair or service due to a force majeure event, the completion of the repair or service will be postponed depending on the nature and scale of the event, subject to the agreement. Force majeure shall mean and include, without limitation, natural phenomena, conflicts, strikes, attacks, unforeseen official restrictions and any other events beyond the control of us. If, while performing the repair or service, we discover that unforeseen additional operations that are not included in the Estimate have to be carried out, we will, as soon as reasonably practicable, send you an additional or updated Estimate for approval including specifically the new operations to be carried out on the watch. Any item entrusted to us for repair or service is accepted only on condition that if they are not collected within six months, we reserve the right to deal with the uncollected goods in accordance with the provision of the Torts Interference with Goods Acts 1977. Claims for loss of goods entrusted to us for repair, will cover commercial costs only. Sentimental value will not be taken into consideration.
IN-STORE RETURNS POLICY
You have 14 days from the day you made your purchased to change your mind. We do not refund on items purchased, in person at our Sutton store. We will happily provide an exchange (does not include items listed under our exclusions list), otherwise a credit note for 12 months will be issued, instead. Credit notes are valid for twelve months from the date of issue. Credit notes are non-transferable and cannot be exchanged for cash. Lost or stolen credit notes will not be replaced. For more information on returning items purchased in-store or items that are excluded from being returned, please read our returns policy.
SECTION 7 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Certain content, products and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. In no case shall Lewins Jewellers, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
EVENTS OUTSIDE OF OUR CONTROL
We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (“Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: Strikes, lock-outs or other industrial action. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. Impossibility of the use of public or private telecommunications networks. The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
SECTION 14 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Lewins Jewellers and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
